Marking the International Day for the Elimination of Violence Against Women (25 November)

We spotlight the critical need for gender-sensitive approaches in shaping and implementing laws and policies across all sectors.

The Court of Justice of the European Union (CJEU) has recently made strides in this direction through key judgments addressing gender sensitivity in asylum policies. By interpreting EU Refugee Law in light of the CEDAW and Istanbul Convention, the Court:
✅ Recognized systematic discrimination as a pivotal factor in asylum cases.
✅ Extended protection to women facing systemic oppression, establishing that individual assessments of circumstances are unnecessary when women are excluded from civil society under regimes of segregation and oppression.

These landmark decisions highlight the imperative of integrating a gender-sensitive lens into legal frameworks to safeguard women against systemic violence and ensure meaningful protection for those affected.
